The PIL, filed by the Nariman Point Churchgate Citizens’ Welfare Trust and others, claims that the BJP office and some state government structures have been built on land allocated for a recreational ground.

The state government submitted that anything not permissible under law must be demolished by the civic body. Advocate General Shrihari Aney said the government’s stand was clear that if any construction or extension is not allowed under the law, the civic body must demolish it. No building plan regarding the plot “to justify the structures” was available, he conceded, and said “anything not permissible under the law must go“. Aney, however, said allotment of the land to the party was lawful, and the entire structure could not be said to be illegal. “Anything wrongly built will be demolished,” he said. In an earlier affidavit, BMC had stated that the space allotted was 2,682 sq ft. The petitioners claim it is spread over 9,000 sq ft. S Kamdar, the BJP’s counsel, told a division bench comprising Justices AS Oka and CV Bhadang that the construction was spread over 4,000 sq ft against the allotted 2,682 sq ft, and it had applied for “area rectification” to the government.

The application was pending, he said. The bench asked Kamdar if the BJP will reduce its office space if some parts were found to have been unlawfully constructed. Kamdar sought time till Thursday to respond to the court’s questions M Doctor, appearing for the petitioners, said the BJP had renovated the premises despite a ‘stop work’ notice from BMC. In an affidavit in 2014, the state said the structures had come up before it was demarcated as recreational in the 1991 development plan. The PIL claimed the space was demarcated as a green zone in 1967. Doctor said no sanctioned plans had been produced to support the legality claim. The matter will be heard again on Thursday.
